Business Agreement

1. Platform Identity

WatamuPulse ("the Platform") is own and operated as a curated digital magazine and business infrastructure Layer for Watamu, Kenya. By accessing the Platform's business dashboard or submitting listing data, you ("the Business") enter into a legally binding agreement.

2. Eligibility Requirements

To list a business on WatamuPulse, you must be a legally registered entity or an authorized sole proprietor operating within the coastal region of Kenya. You must provide accurate, current, and complete information during the onboarding process.

3. Subscription & Payment Terms

  • Payments are processed via M-Pesa STK Push or designated card processors.
  • Subscriptions are non-refundable once the business listing is published or the website is hosted.
  • Failure to renew a subscription will result in the immediate hiding of the business card and suspension of hosted websites.

4. Website Hosting Terms

Businesses uploading .zip files for hosting acknowledge that:

  • WatamuPulse reserves the right to scan and refuse files containing malicious code.
  • Hosting is provided on Firebase Storage/Hosting nodes; uptime is subject to Google Cloud Platform SLA.
  • You are solely responsible for the content, licensing, and legality of the files uploaded.

5. Data & Analytics Disclaimer

Analytics provided in the dashboard are for informational purposes. WatamuPulse uses industry-standard tracking but does not guarantee the conversion of leads into revenue. Analytics data remains the property of WatamuPulse but is licensed to you during an active subscription.

6. Limitation of Liability

To the maximum extent permitted under Kenyan law, WatamuPulse shall not be liable for any indirect, incidental, or consequential damages arising from service interruptions, data loss, or disputes between businesses and Platform visitors.

7. Termination

We reserve the right to terminate access for businesses that promote illegal activities, provide fraudulent information, or breach community standards established for the Watamu brand.

8. Governing Law

This agreement is governed by the Laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Malindi or Mombasa.
